Terms and Conditions

1. Instructions on how to enter form part of the conditions of entry. By participating entrants agree to be bound by these conditions.

2. The promoter is Microsoft Pty Limited, ACN 002 589 460 of

1 Epping Road, North Ryde, New South Wales

, 2113.

3. Entry is open to Australian residents. Non-Australian residents may submit an entry but are not eligible for prizes, and their entries will not be judged. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies may submit an entry, but are not eligible for prizes, and their entries will not be judged. There is no limit to the number of entries per entrant. Eligible entrants are only eligible to win one prize.

4. The promoter reserves the right to verify the validity of entries and to disqualify any entrant who the promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.

5. The promoter reserves the right to disqualify any entrant who has submitted an entry the promoter believes in its own judgement to be inappropriate (including, but not limited to, obscene, illegal, defamatory or unsavoury content).

6. The competition commences at 9:00am (Sydney time) on Monday, April 21 2008 and closes at 10:00am (Sydney time) on Monday, May 12 2008. To enter, create a Microsoft Silverlight™ “music video clip” for the song clip provided, and upload it to Microsoft Silverlight Streaming and submit your entry by email according to the How To Enter instructions at: https://blogs.msdn.com/shanemo/pages/how-to-enter-oz-remix-silverlight-video-clip-contest.aspx .

7. The terms and conditions of usage of Microsoft Silverlight Streaming (found at https://dev.live.com/terms/default.aspx form part of these terms and conditions.

8. All valid eligible entries received bythe closing date will be reviewed by the judging panel. Entries will be judged using a PC running Microsoft Windows Vista, Internet Explorer 7, and Silverlight 1, or Silverlight 2 Beta 1, as required. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creativity and quality.

9. The best entry will win the First Prize, a Microsoft Silverlight skateboard and a ticket to Remix 08 Australia Event in either Melbourne or Sydney. The entry judged to be the second best will win the Second prize, a generation 1 Microsoft Zune® (*Note: Some of the online features may not operate in Australia) and a ticket to Remix 08 Australia Event in either Melbourne or Sydney. The entry judged to be the third best will win the Third Prize, a Microsoft Wireless Notebook Presenter Mouse 8000 (RRP is $129) and a ticket to Remix 08 Australia Event in either Melbourne or Sydney. Total number prizes = 3. Winners can select whether they will attend the Sydney or Melbourne Remix 08 Australia Event and will notify the promoter immediately upon notification of winning a prize. Note that refunds are not available for prize winners who have already purchased a Remix 08 Australia Event ticket. Winners may transfer their Remix 08 Australia Event ticket prize to another person. Prizes are not exchangeable, transferable or redeemable for cash. If the promoter is unable to supply the nominated prize, the promoter reserves the right to supply another prize of greater or equal value.

10. All travel expenses and other expenses related to attending Remix 08 Australia Event in either Melbourne or Sydney are not included in the prizes and obtaining any of these is the responsibility of each winner. In the event that, for any reason whatsoever, the winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

11. All entries become the property of the promoter. The promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.

12. All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant. Any form of automated entry using other devices or software is invalid.

13. The promoter accepts no responsibility for entries which cannot be correctly viewed by the judges. Entries will be judged using a PC running Microsoft Windows Vista, Internet Explorer 7, and Silverlight 1, or Silverlight 2 Beta 1, as required.

14. The entrant warrants that the material (with the exception of the song clip provided by us) contained in its entry is original and does not infringe the intellectual property rights of any third person. Subject to any applicable law which cannot be excluded, the entrant indemnifies the promoter and its related bodies corporate so that they will not be liable (either jointly or severally) for any loss, damage or injury suffered or sustained arising from third party claims (including any claims of intellectual property infringement) arising directly or indirectly out of or in connection with the use of an entry.

15. The stated prize value is the recommended retail value or estimated value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize.

16. Winners of all prizes will be notified via email at the email address supplied in the entry by Thursday May 15 2008.

17. In the event that a prize is not claimed and the selection to attend either the Sydney or Melbourne Remix 08 Australia Event is not made by Monday May 19 2008, the judges will select an alternate winner to receive the prize.

18. If a winner of the prize is under the age of 18 years, the prize will be awarded to the winner subject to the prior written consent of the winner’s parent or legal guardian. The Promoter may make such inquiries as it deems necessary to satisfy itself that such consent has been obtained.

19. Subject to any applicable law which cannot be excluded, the promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.

20. Before the prize is awarded, if requested by the promoter, the winner will be required to sign a form to release the promoter from and indemnify the promoter against, any and all liability arising from the use or participation in the prize.

21. Prizes can be collected at Remix 08 Australia Event, or if they have not been collected at the relevant Event in either Sydney or Melbourne, the uncollected prize will be shipped to the winner within Australia. The Promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.

22.  Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.

23. The promoter assumes no responsibility for, and the entrant releases the promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.

24. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the promoter’s privacy policy which is available at www.microsoft.com/australia/privacy.
