Office 365 and third-party terminal server

Question

We are a Neusser software developer and offer our customers ASP to have your local IT moved to our servers.

A potential new customer now wants to take advantage of this offer and at the same time switch to Office 365. The question now is whether this is okay under licensing law and which variant of Office 365 the customer needs to use.
